| DECISION & ORDER ON MOTION |
Appeal from an order of the Supreme Court, Kings County, dated December 11, 2020. Motion by the appellant to stay enforcement of so much of the order as, sua sponte, directed the dismissal of the complaint and to stay the commencement of any landlord tenant proceedings in the Civil Court of the City of New York, Kings County.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that on the Court's own motion, the notice of appeal is treated as an application for leave to appeal to this Court from so much of the order as, sua sponte, directed the dismissal of the complaint and leave to appeal is granted; and it is further,
ORDERED that the motion is denied.
