DECISION & ORDER ON MOTION

2021-00160

Anthony P. Maida, respondent,

v Christine J. Svetina, appellant.

(Index No. 3649/2018)

Appeals from two orders of the Supreme Court, Suffolk County, dated November 4, 2020, and December 22, 2020, respectively. Motion by the appellant to stay enforcement of stated portions of the orders, pending hearing and determination of the appeals.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that on the Court's own motion, the appeal from the order dated November 4, 2020, is dismissed, without costs or disbursements, on the ground that no appeal lies from an order entered upon the default of the appealing party (see CPLR 5511); and it is further,

ORDERED that the motion is denied.

RIVERA, J.P., CHAMBERS, HINDS-RADIX and DUFFY, JJ., concur.
