| DECISION & ORDER ON MOTION |
Appeal from a judgment of the Supreme Court, Suffolk County, rendered March 16, 2015. Motion by the appellant, in effect, to enlarge the record to include papers relating to a motion pursuant to CPL 440 initiated by notice of motion dated February 4, 2020, and to waive certification of the appellant's appendix pursuant to 22 NYCRR 1250.7(g).
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the branch of the motion which is, in effect, to enlarge the record to include papers relating to a motion pursuant to CPL 440 initiated by notice of motion dated February 4, 2020, is denied; and it is further,
ORDERED that the branch of the motion which is to waive certification of the appellant's appendix pursuant to 22 NYCRR 1250.7(g) is denied without prejudice to renew upon submission of a proposed appendix that does not contain matters dehors the record.
