Dr. Michael Herman, as Assignee of Kevin Fleetwood, Appellant, v Country-Wide Insurance Company, Respondent.

Motion by appellant to consolidate appeals from orders of the Civil Court of the City of New York, Queens County, entered February 27, 2019 (appeal No. 2020-988 Q C) and April 14, 2020 (appeal No. 2020-1016 Q C), respectively. Separate motion by appellant for leave to prosecute appeal No. 2020-988 Q C under the Appellate Term rules effective January 1, 2020 (22 NYCRR Part 731, et seq).

Upon the papers filed in support of the motion and no papers having been filed in opposition thereto, it is

ORDERED that the motion for leave to prosecute appeal No, 2020-988 Q C under the Appellate Term rules effective January 1, 2020 (22 NYCRR Part 731, et seq), including 22 NYCRR §731.9 governing records on appeal, is granted; and it is further,

ORDERED that the motion to consolidate the appeals is granted to the extent that the parties may each file one brief addressing both appeals, and the appeals will be scheduled by the court to be heard together on the same day; and it is further,

ORDERED that the appeals shall proceed under the deadlines set forth for appeal No. 2020-1016 Q C.
