DECISION & ORDER ON MOTION

Appeal from an order of the Family Court, Westchester County, dated January 15, 2021. Motion by Kenneth Sookchan for leave to appeal to this Court from the order and to stay enforcement of the order, pending hearing and determination of the appeal.

Upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, it is

ORDERED that the motion is dismissed for failure to pay the motion filing fee (see CPLR 8022[b]); and it is further,

ORDERED that on the Court's own motion, the appeal is dismissed, without costs or disbursements, as no appeal lies as of right from a nondispositional order in a proceeding pursuant to Family Court Act article 6, part 3 (see Family Ct Act § 1112), and leave to appeal has not been granted.
