Appeal and cross appeals from an order of the Supreme Court, Kings County, dated June 29, 2020. Motion by Briarwood MP, LLC, and Pav-Lak Contracting, Inc., to dismiss the cross appeal by CRV Precast Construction, LLC, as untimely taken. Cross motion by CRV Precast Construction, LLC, to deem its notice of appeal timely nunc pro tunc.
Upon the papers filed in support of the motion and the cross motion, and the papers filed in opposition thereto, it is
ORDERED that the motion is denied; and it is further,
ORDERED that the cross motion is denied.
