Appeals from two orders of the Supreme Court, Kings County, dated May 27, 2009, and February 18, 2020, respectively. Motion by the respondents to dismiss the appeal from the order dated May 27, 2009, in effect, on the ground that no appeal lies as of right from an order that does not decide a motion made on notice.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the motion is held in abeyance and referred to the panel of Justices hearing the appeal for determination upon the argument or submission thereof.
