The People of the State of New York, Respondent, v Marie M. Kinkela, Appellant.

Motion by appellant on an appeal, in a dangerous dog proceeding, from an order of the District Court of Nassau County, Third District, entered July 27, 2018, for summary reversal. Separate motion by respondent to dismiss the appeal.

Upon the papers filed in support of the motions and the papers filed in opposition thereto, it is

ORDERED that the motions are consolidated for purposes of disposition; and it is further,

ORDERED that respondent's motion to dismiss the appeal is denied; and it is further,

ORDERED that appellant's motion is held in abeyance and referred to the panel of Justices hearing the appeal for determination upon the argument or submission thereof.
