| DECISION & ORDER ON MOTION |
Appeal from a decision of the Supreme Court, Nassau County, dated May 23, 2019, which was dismissed in a decision and order on motion of this Court dated December 14, 2020. Motion by the appellant, in effect, for leave to reargue his opposition to the motion to dismiss the appeal, or in the alternative, for leave to appeal to the Court of Appeals from the decision and order on motion of this Court dated December 14, 2020. Cross motion by the respondent to reinstate her prior motion to strike the appellant's appendix and the appellant's brief and to extend the time to serve and file a brief, in the event the appellant's motion is granted.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, and upon the papers filed in support of the cross motion and no papers having been filed in opposition or in relation thereto it is
ORDERED that the motion is denied; and it is further,
ORDERED that the cross motion is denied as academic.
