DECISION & ORDER ON MOTION

Appeal by Harold Brookins from an order of the Supreme Court, Kings County, dated January 4, 2021. By order to show cause dated February 1, 2021, the parties were directed to show cause before this Court why the appeal should or should not be dismissed on the ground that the order dated January 4, 2021, is not appealable as of right and leave to appeal has not been granted (see CPL 450.10, 450.15).

Now, upon the order to show cause and the papers filed in response thereto, it is

ORDERED that the motion to dismiss the appeal is granted and the appeal is dismissed, without costs or disbursements.
