Respondent-appellant New York State Liquor Authority having moved for a stay of all proceedings to enforce a judgment of the Supreme Court, Erie County, entered January 28, 2021, pending the hearing and determination of the appeal taken herein, and having moved for other relief,
Now, upon reading and filing the papers with respect to the motion, and due deliberation having been had thereon,
It is hereby ORDERED that the motion is granted to the extent that petitioner-respondent Pharaohs GC, Inc. is preliminarily enjoined from having exotic dancing performed on its premises during the pendency of this appeal on the condition that the appeal is perfected on or before April 23, 2021, in which case petitioner-respondent's brief shall be filed and served on or before May 7, 2021, and any reply brief shall be filed and served on or before May 12, 2021, and the appeal shall be scheduled for the term commencing May 17, 2021.
