v Jonathan Davidoff, respondent.

(Index No. 61571/2018)

DECISION & ORDER ON MOTION

Appeal from an order of the Supreme Court, Westchester County, dated March 5, 2021. Motion by Stefanie Davidoff for leave to appeal to this Court from the order dated March 5, 2021, to direct the Supreme Court, Westchester County, to "turn over" the transcript of certain proceedings which occurred on July 25, 2019, to stay the trial on the issue of custody and parental access or, in the alternative, to unseal the transcript of the proceedings which occurred on July 25, 2019.

Upon the papers filed in support of the motion and the papers filed in opposition and in relation thereto, it is

ORDERED that the branch of the motion which is for leave to appeal is denied as unnecessary as the order is appealable as of right (see CPLR 5701); and it is further,

ORDERED that the motion is otherwise denied.

RIVERA, J.P., BARROS, CHRISTOPHER and WOOTEN, JJ., concur.
