DECISION & ORDER ON MOTION

Motion by the appellant to amend a decision and order on motion of this Court dated March 8, 2018, which assigned counsel in connection with his application for a writ of error coram nobis to vacate, on the ground of ineffective assistance of appellate counsel, a decision and order of this Court dated May 31, 2011 (People v Louis, 84 AD3d 1410), affirming a judgment of the Supreme Court, Kings County, rendered October 20, 2008, and for leave to raise additional issues in connection with the application for a writ of error coram nobis.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the motion is denied; and it is further,

ORDERED that assigned counsel shall serve the brief concerning the issue of whether trial counsel was ineffective for failing to move to dismiss the misdemeanor counts of the indictment as time barred and upload a digital copy of the brief, with proof of service thereof, through the digital portal on this Court's website, on or before June 11, 2021, and assigned counsel shall file an original and five hard copies of the brief in accordance with any applicable administrative order or other order to be issued by the Court.
