| DECISION & ORDER ON MOTION |
Appeal from a judgment of the Supreme Court, Nassau County, entered September 25, 2019. Motion by the appellant, in effect, to recall and vacate so much of a decision and order on application of this Court dated September 11, 2020, as deemed the appeal withdrawn and to reinstate the appeal.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the motion is granted, so much of the decision and order on application of this Court dated September 11, 2020, as deemed the appeal withdrawn is recalled and vacated, and the appeal is reinstated; and it is further,
ORDERED that on the Court's own motion, the appellant's time to serve and file the record or appendix on the appeal and the appellant's brief via NYSCEF is extended until June 2, 2021, and the appellant shall file an original and five hard copies of the record or appendix and the appellant's brief in accordance with any applicable administrative order or other order to be issued by the Court.
