Appeal and cross appeals from an order of the Supreme Court, Kings County, dated June 27, 2019. Motion by the appellants-respondents to dismiss the cross appeal by Kenneth Reynolds on the ground that he failed to pay a one-third share of the cost of the joint record on appeal.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the motion is denied on condition that on or before June 21, 2021, the respondent-appellant Kenneth Reynolds pay a one-third share of the cost of the joint record on appeal (see 22 NYCRR 1250.9[f][1][ii]) and file proof of payment with the Clerk of this Court via e-mail to [email protected].
