| DECISION & ORDER ON MOTION |
Appeal from an order of the Supreme Court, Queens County, entered November 20, 2019. Motion by the appellants to strike the respondent's brief on the ground that it refers to matter dehors the record and to extend the time to serve and file a reply brief.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the motion is granted; and it is further,
ORDERED that the respondent's brief is stricken, on or before June 21, 2021, the respondent shall serve and file via NYSCEF a replacement brief that does not contain the material in the last two sentences in footnote 1 on page 9, and the respondent shall file an original and five hard copies of the replacement brief in accordance with any applicable administrative order or other order to be issued by the Court; and it is further,
ORDERED that the appellants' time to serve and file a reply brief is extended, on or before July 1, 2021, the appellants shall serve and file via NYSCEF the reply brief, and the appellants shall file an original and five hard copies of the reply brief in accordance with any applicable administrative order or other order to be issued by the Court.
