DECISION AND ORDER
ON MOTION

Application, pursuant to CPL 460.50, for order staying execution of judgment of County Court, Ulster County, rendered May 26, 2021, pending appeal and for release on recognizance or bail.

Upon the papers filed in support of the application and the papers filed in opposition thereto, it is


ORDERED that the application is granted, and defendant is released on recognizance pending determination of the appeal, and it is further
ORDERED that defendant shall remain under the supervision of the Ulster County Probation Department pending determination of the appeal, and it is further
ORDERED that defendant shall notify this Court, in writing, within 24 hours of any arrest or charges alleging violation of the Penal Law and/or the Vehicle and Traffic Law, and it is further

ORDERED that defendant shall remain at the property located at 2072 Route 32, Apartment 4, Saugerties, New York, 12472, at all times during the pendency of the appeal except for travel to and from employment, medical appointments, school and any destination required by the Ulster County Probation Department, and it is further

ORDERED that defendant shall remain within the State of New York at all times during the pendency of the appeal, and it is further

ORDERED that defendant shall surrender any passport possessed by him to the Clerk of the Court, and it is further

ORDERED that defendant shall not possess or consume any alcoholic beverages, marihuana or illegal drugs during the pendency of the appeal.
