DECISION & ORDER ON MOTION

Appeal from a judgment of the Supreme Court, Queens County, dated July 2, 2019. Motion by the respondent to vacate a stay of the foreclosure sale of the subject premises, which was granted by decision and order on motion of this Court dated February 21, 2020, pending hearing and determination of the appeal, and to dismiss the appeal for failure to timely perfect.

Upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, it is

ORDERED that the motion is denied as unnecessary, as the appeal has been deemed dismissed (see 22 NYCRR 1250.10[a]).
