An order having been entered on May 26, 2021, granting respondent-appellant's application to perfect an appeal taken herein as a poor person and assigning Mark Funk, as counsel to perfect the appeal,
Now, upon reading and filing the statement of Mark Funk, Esq., dated June 30, 2021, and due deliberation having been had thereon,
It is hereby ORDERED that Gary Muldoon, Esq., 135 Corporate Woods, Suite 300, Rochester, New York 14623-1459, is hereby substituted as counsel to conduct the above-entitled appeal taken from an order of the Family Court, Monroe County, entered April 2, 2021, in place and stead of Mark Funk, Esq., and
It is further ORDERED that the Monroe County Family Court Clerk provide Gary Muldoon, Esq. with copies of all papers and transcripts of stenographic or audiotaped minutes, if any, of the proceedings upon which the appeal is based, and
It is further ORDERED that the time to perfect the appeal is extended to September 17, 2021, and, in the event of failure to so perfect, the appeal is hereby dismissed without further order.
