DECISION & ORDER ON MOTION

Appeal from a judgment of the Supreme Court, Queens County, entered February 21, 2017, which was determined by decision and order of this Court dated September 30, 2020. Motion by the respondent pursuant to CPLR 5015(a)(4) and (a)(5) to vacate the decision and order dated September 30, 2020, and a decision and order on motion of this Court dated July 5, 2018, which granted the appellant's motion to extend the time to perfect the appeal, on the ground that the appellant's motion was improperly served, and deem the appeal dismissed, in effect, pursuant to 22 NYCRR 1250.10(a).

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the motion is denied.
