DECISION & ORDER ON MOTION

Motion by Marlon Sanders to assign Randall D. Unger as counsel for the purpose of filing an application pursuant to CPL 450.15 and 460.15 for a certificate granting leave to appeal to this Court from an order of the Supreme Court, Queens County, dated May 28, 2021.

Upon the papers filed in support of the motion and the papers filed in relation thereto, it is

ORDERED that the motion is denied, without prejudice to Randall D. Unger filing a timely application pursuant to CPL 450.15 and 460.15 for a certificate granting leave to appeal to this Court from the order of the Supreme Court, Queens County, dated May 28, 2021 (see 22 NYCRR §§ 671.2, 671.3).
