| DECISION & ORDER ON MOTION |
Appeal from an order of the Supreme Court, Suffolk County, dated October 4, 2019, and a judgment of the same court entered December 7, 2020. Motion by the appellant, in effect, to consolidate the appeals, to deem the record and briefs filed in connection with the appeal from the order to also be filed in connection with the appeal from the judgment, and for leave to serve and file a supplemental record containing the judgment and the notice of appeal from the judgment.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the motion is granted, the appeals are consolidated, the record and briefs filed in connection with the appeal from the order are deemed also to be filed in connection with the appeal from the judgment, on or before September 17, 2021, the parties shall submit corrected covers for the copies of the record and briefs filed with the Clerk of the Court which contain Appellate Division Docket No. 2021-01130 in addition to Appellate Division Docket No. 2019-13961 and file, via NYSCEF, digital replacement copies of the record and briefs which contain the corrected covers, and the appellant shall serve and file via NYSCEF a supplemental record containing the judgment and the notice of appeal from the judgment.
