Motion for extension of time to perfect appeals, to consolidate and for further relief.
Upon the papers filed in support of the motion, and no papers having been filed in opposition thereto, it is
ORDERED that
the motion to consolidate is granted, without costs, to the extent that the appeals shall be heard together and may be perfected upon a joint record on appeal and brief, and it is further
ORDERED that the motion for an extension of time to
perfect the appeals is granted, without costs, and the time is extended to October 18, 2021. It is further
ORDERED that Mitchell S. Kessler, Esq., 63 Pike Creek Dr., Cohoes, NY 12047-1229, 518-235-6312, is assigned to represent
appellant upon these appeals pursuant to Judiciary Law § 35 (1) (b), and it is further
ORDERED that appellate counsel shall register the appeals with NYSCEF within 14 days of the date of this decision and order, and it is
further
ORDERED that the appeals shall be perfected by the appendix method in accordance with section 1250.5 (c) of the Practice Rules of the Appellate Division and sections 850.7 (b) and 850.9 (a) of this Court's Rules of Practice, and
it is further
ORDERED that pursuant to CPLR 1102 (b), the Albany County Court Clerk shall furnish to appellate counsel one copy of the transcripts of the stenographic minutes of all proceedings in this matter and one copy of
any other paper or document on file in that office which is material and relevant to these appeals, except those portions which appellate counsel or the court from which the appeals are taken determines are unnecessary for perfection of the
appeals, and to forward forthwith the other copy of said transcripts to the Clerk of this Court, and the transcripts shall be omitted from the hard copy and the electronic copy of the record.
