Counsel for appellant having moved to withdraw her brief on the appeal taken herein from a judgment of the Supreme Court, Ontario County, entered June 26, 2017, and for other relief,
Now, upon reading and filing the papers with respect to the motion, and due deliberation having been had thereon,
It is hereby ORDERED that the motion is granted, and
It is further ORDERED that the appeal is removed from the Court's October 26, 2021 day calendar, and
It is further ORDERED that Michael J. Pulver, Esq., 110 Hoytville Avenue, North Syracuse, New York 13212-3602, 465 Grant Street, Buffalo, New York 14213, is substituted as counsel to conduct the above-entitled appeal in place of the Legal Aid Bureau of Buffalo, Inc., and said appeal may be prosecuted upon one appendix as defined by 22 NYCRR 1000.7(d), with proof of service of one copy on each opposing party; a certified transcript of the trial or hearing, if any; a copy of the Pre-Sentence Investigation Report, if relevant; a demand for exhibits are in the control of a respondent or third party with proof of service, when necessary; and an original, five hard copies and one digital copy of appellant's brief reproduced in accordance with 22 NYCRR 1250.8; and
It is further ORDERED that the Clerk of Ontario County is directed to provide Michael J. Pulver, Esq., with copies of all papers and transcripts of stenographic, digitally recorded, or audiotaped minutes, if any, of the proceedings upon which the appeal is based; and
It is further ORDERED that said records and briefs are to be filed and served on or before January 18, 2022.
