DECISION & ORDER ON MOTION
| The People of the State of New York, Respondent, v Christopher Fusco, Appellant. |
Appeal from an "order" of the Justice Court of the Town of Poughkeepsie, Dutchess County, made on or about December 15, 2020.
On the court's own motion, it is
ORDERED that the appeal is dismissed.
No appeal lies from an order denying an oral application to dismiss the accusatory instrument (see CPL 450.10, 450.15). Defendant may, if so advised, move this court for leave to file a late notice of appeal from a judgment of conviction rendered December 15, 2020 (see CPL 460.10, 460.30).
