Defendant having moved pursuant to CPL 460.30 to extend the time to take an appeal from a judgment of the Niagara County Court, rendered February 27, 2019, and for relief pursuant to CPL 460.50,
Now, upon reading and filing the papers with respect to the motion, and due deliberation having been had thereon,
It is hereby ORDERED that the motion seeking an extension of time to file a notice of appeal is granted, and Frank A. LoTempio, III, Esq., is directed to file and serve the notice of appeal in accordance with CPL 460.10 on or before November 26, 2021.
And it is further ordered that the motion seeking relief pursuant to CPL 460.50 is denied.
