| DECISION AND ORDER ON MOTION |
Proceeding pursuant to CPLR article 78, inter alia, to void and invalidate certain proceedings in a matter entitled Altiner v Ates, commenced in the Supreme Court, Suffolk County, under Index No. 7928/2016, and application by the petitioner for poor person relief.
ORDERED that the application is denied; and it is further,
ORDERED that on the Court's own motion, in the event that the filing fee has not been paid within 120 days from the date of this decision and order on motion the proceeding shall be dismissed (see CPLR 1101[d]; 8022[b]).
