DECISION & ORDER ON MOTION

Motion by respondent to dismiss the appeal from a judgment of conviction of the District Court of Suffolk County, Traffic and Parking Violations Agency, rendered February 25, 2021. Separate motions by appellant for permission to file late opposition to the motion to dismiss the appeal, and to compel the Suffolk County, Traffic and Parking Violations Agency to turn over the audio from the February 25, 2021 proceeding to the certified transcriber designated by appellant.
Upon the papers filed in support of the motion and the papers sought to be filed in opposition thereto, it is
ORDERED that the motions are consolidated for the purpose of disposition; and it is further
ORDERED that the motion for permission to file late opposition to the motion to dismiss the appeal is granted, and the papers in support of the motion are deemed filed; and it is further
ORDERED that the motion to dismiss the appeal is denied; and it is further,
ORDERED that the motion to compel is granted, and the Suffolk County, Traffic and Parking Violations Agency shall provide a copy of the audio from the February 25, 2021 proceedings to the certified transcriber designated by appellant, within 15 days of the date of this decision and order on motion.
