DECISION & ORDER ON MOTION

On the Court's own motion, it is

ORDERED that the decision and order on motion of this Court dated October 13, 2021, in the above-entitled case is recalled and vacated, and the following decision and order on motion is substituted therefor:

Appeal by Theresa Merriweather from an order of the Supreme Court, Kings County, (IDV Part) dated November 4, 2020. Motion by the appellant's assigned counsel to be relieved and for the assignment of new counsel. By order on certification of this Court dated November 18, 2020, the appellant was granted leave to proceed as a poor person on the appeal, and the following attorney was assigned as counsel for the appellant on the appeal:

Upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, it is
