| DECISION & ORDER ON MOTION |
Appeal from a judgment of the Supreme Court, Kings County, rendered October 30, 1997, which was determined, following remittitur from the Court of Appeals, by decision and order dated August 20, 2014. Motion by the respondent to strike the appellant's reply filed in connection with the appellant's application for a writ of error coram nobis, on the ground that it improperly raises issues for the first time in reply.
Upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, it is
ORDERED that the motion is granted to the extent that the new issues raised for the first time in the appellant's reply will not be considered in connection with the application for a writ of error coram nobis, and the motion to strike is otherwise denied.
