Motion by defendant for an order requiring the clerk of the SCTPVA to accept appellant's notice of appeal as timely, or, in the alternative, fo leave to file late notice of appeal from a judgment of conviction of the District Court of Suffolk County, Traffic and Parking Violations Agency, rendered January 11, 2021.
Upon the papers filed in support of the motion and the papers having been filed in opposition thereto, it is
ORDERED that the motion is granted to the extent that leave to file a late notice of appeal is granted, and defendant's moving papers are deemed to constitute a timely notice of appeal.
