Appeal from an order of the Supreme Court, Queens County, dated August 4, 2021, which was dismissed in a decision and order on motion of this Court dated September 20, 2021. Motion by the appellant for leave to reargue the prior motion by the respondent to dismiss the appeal, his cross motion to preclude the respondent's counsel Ackerman LLP from filing papers in connection with this appeal, and his separate motion to direct the respondent to comply with CPLR 321(b) and to stay all proceedings in the above-entitled action, pending hearing and determination of the appeal, which were determined in the decision and order on motion of this Court dated September 20, 2021, or, in the alternative, for leave to appeal to the Court of Appeals from the decision and order on motion of this Court dated September 20, 2021.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the motion is denied.
