| DECISION & ORDER ON MOTION |
Appeal from an order of the Supreme Court, Suffolk County, dated September 1, 2021. Motion by the appellant for leave to appeal to this Court from the order, to stay the trial in the above-entitled action, pending hearing and determination of the appeal, and for a preference in the calendaring of the appeal.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the branch of the motion which is for leave to appeal to this Court is denied as unnecessary, as the order is appealable as of right (CPLR 5701[a]); and it is further,
ORDERED that the branch of the motion which is for a preference in the calendaring of the appeal is granted and the appeal will be calendared expeditiously after all of the briefs have been filed; and it is further,
ORDERED that the motion is otherwise denied.
