DECISION & ORDER ON MOTION

Appeal from an order of the Family Court, Westchester County, dated January 8, 2020. Motion by the respondent to dismiss the appeal, inter alia, as untimely taken and on the ground that the appellant's prior motion for poor person relief and the assignment of counsel was not properly served.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the motion is denied; and it is further,

ORDERED that on the Court's own motion, the time of the respondent and the attorneys for the children to serve and file their respective briefs is extended, and on or before December 13, 2021, the respondent and the attorneys for the children shall serve and file their respective briefs, if any, via NYSCEF, if applicable, or, if NYSCEF is not mandated, serve the briefs and upload a digital copy of the briefs, with proof of service thereof, through the digital portal on this Court's website.
