Appeal from a resentence of the Supreme Court, Queens County, imposed February 5, 2019, which was determined by decision and order of this Court dated May 5, 2021. Motion by the respondent for leave to appeal to the Court of Appeals from the decision and order of this Court.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that leave to appeal to the Court of Appeals from the decision and order of this Court dated May 5, 2019, in the above-entitled case is granted; in my opinion, a question of law has arisen, which ought to be reviewed by the Court of Appeals.
