DECISION & ORDER ON MOTION

Appeal from a judgment of the Supreme Court, Westchester County, dated February 3, 2020. Motion by the appellant to extend the time to perfect the appeal. Cross motion by the respondent to dismiss the appeal for failure to timely perfect, for an award of costs, and to impose a sanction upon the appellant.

Upon the papers filed in support of the motion and the cross motion, and the papers filed in opposition thereto, it is

ORDERED that the motion to extend the time to perfect the appeal is denied; and it is further,

ORDERED that the branch of the cross motion which is to dismiss the appeal is denied as unnecessary, as the appeal was deemed dismissed pursuant to 22 NYCRR 1250.10(a); and it is further,

ORDERED that the cross motion is otherwise denied.
