2021-07613 The People, etc., respondent, v James Payne, appellant. (Ind. No. 290/2012)
| DECISION & ORDER ON MOTION |
Appeal from an order of the Supreme Court, Nassau County, dated June 25, 2021. By order to show cause dated October 27, 2021, the appellant was directed to show cause before this Court why the appeal in the above-entitled action should or should not be dismissed on the ground that the order is not appealable as of right and leave to appeal has not been granted.
Now, upon the order to show cause and no papers have been filed in response thereto, it is
ORDERED that the motion is granted, and the appeal is dismissed, without costs or disbursements (see CPL 450.10, 450.15).
BARROS, J.P., RIVERA, MALTESE and FORD, JJ., concur.
