Order To Show Cause
Appeal from a judgment of the District Court of Nassau County, Second District, entered December 3, 2018.
On the court's own motion, it is
ORDERED that the parties or their attorneys show cause why an order should or should not be entered dismissing the appeal, by filing an affidavit or affirmation with the court on or before February 2, 2022.
By Decision & Order on Motion dated February 25, 2020, the matter was remitted to the District Court for a hearing to be held within 30 days of this decision and order on motion to determine whether appellant Manuel Abull is an adult incapable of adequately defending his rights and, if so, for the appointment of a guardian ad litem pursuant to CPLR 1202. The District Court was ordered to "cause its determination to be filed with the clerk of this court with all deliberate speed." To date, no such report has been filed.
