DECISION & ORDER ON MOTION

Motion by Wayne Thatcher for reinstatement to the Bar as an attorney and counselor-at-law. Mr. Thatcher was admitted to the Bar at a term of the Appellate Division of the Supreme Court in the Second Judicial Department on February 3, 1993. By decision and order on motion of this Court dated July 9, 2018, Mr. Thatcher was directed to show cause at a hearing pursuant to 22 NYCRR 1240.12(c)(3)(iii), before Norma Giffords, as Special Referee, why a final order of suspension, censure, or disbarment should not be made based on his conviction of forcible touching, in violation of Penal Law § 130.52, a class A misdemeanor. By opinion and order of this Court dated September 25, 2019, Mr. Thatcher was suspended from the practice of law for a period of two years, commencing on October 25, 2019.

Upon the papers filed in support of the motion and the papers filed in relation thereto, it is

ORDERED that the motion is held in abeyance and the matter is referred to the Committee on Character and Fitness to investigate and report on Wayne Thatcher's current fitness to practice law, including, but not limited to, his acknowledgment of wrongdoing and the impact that his misconduct had on his clients/victims, his remorse, his compliance with the terms and conditions of probation, including treatment, and his involvement in any lawsuits.
