Respondent-appellant having applied for permission to proceed as a poor person and for assignment of counsel on the appeal taken herein from an order of the Family Court, Monroe County, entered September 15, 2021,

An order having been entered on December 27, 2021, granting respondent-appellant's application to perfect an appeal taken herein as a poor person and assigning the Monroe County Public Defender, as counsel to perfect the appeal,

Now, upon reading and filing the statement of Drew R. DuBrin, Esq., dated January 17, 2022, and due deliberation having been had thereon,

It is hereby ORDERED that Mark Funk, Esq., Monroe County Conflict Defender, 16 East Main Street, Suite 600, Rochester, New York 14614, is hereby substituted as counsel to conduct the above-entitled appeal taken from an order of the Family Court, Monroe County, entered September 15, 2021, in place and stead of the Monroe County Public Defender, and

It is further ORDERED that the Monroe County Family Court Clerk provide Mark Funk, Esq. with copies of all papers and transcripts of stenographic or audiotaped minutes, if any, of the proceedings upon which the appeal is based.
