DECISION & ORDER ON MOTION

Neil R. Flaum was admitted to the Bar at a term of the Appellate Division of the Supreme Court in the Second Judicial Department on February 25, 1976, under the name Neil Russell Flaum. The Grievance Committee for the Ninth Judicial District commenced this proceeding pursuant to 22 NYCRR 1240.8 by the service and filing of a notice of petition and a verified petition, both dated March 6, 2020, and Mr. Flaum served and filed a verified answer dated March 25, 2020. Subsequently, the Grievance Committee served and filed a statement of disputed and undisputed facts dated April 21, 2020, which was not challenged by Mr. Flaum. By opinion and order of this Court dated December 15, 2021, this Court granted a joint motion pursuant to 22 NYCRR 1240.8(a)(5) for discipline on consent and suspended the respondent, Neil R. Flaum, admitted as Neil Russell Flaum, from the practice of law for a period of one year, commencing January 17, 2022.

On the Court's own motion, it is

ORDERED that the opinion and order dated December 15, 2021, is recalled and vacated, and the above-entitled disciplinary proceeding is discontinued, in light of the death of Neil R. Flaum, admitted as Neil Russell Flaum, on October 20, 2021.
