App. Div. order of 11/12/20; affirmance insofar as appeal from; leave to appeal granted by Court of Appeals, 9/14/21; Limitations of Actions--Whether defendants' payments under a Home Affordable Modification Trial Period Plan reset the statute of limitations in this mortgage foreclosure action pursuant to General Obligations Law § 17-101 or § 17-107; Supreme Court, Kings County, denied those branches of plaintiff's motion which were for summary judgment on the complaint insofar as asserted against defendants Maxi Jeanty and Sherley Jeanty for an order of reference, and granted those defendants' cross motion for summary judgment dismissing the complaint insofar as asserted against them as time-barred; App. Div. affirmed insofar as appeal from.

PEOPLE v HARTLE (MARK A.) (192 AD3d 1199):
3rd Dept. App. Div. order of 3/4/21; affirmance; leave to appeal granted by Wilson, J., 9/3/21; Crimes--Vacatur of Judgment of Conviction--Whether deleted text messages and photographs between defendant and the victim, which were recovered from defendant's cell phone after trial through the use of technological advances, constituted newly discovered evidence warranting a new trial; Crimes--Right to Counsel--Whether defendant was denied the effective assistance of counsel because of a potential conflict of interest; County Court, St. Lawrence County, denied defendant's motion pursuant to CPL 440.10 to vacate the judgment convicting him of the crimes of rape in the first degree (four counts), criminal sexual act in the first degree (four counts), sexual abuse in the first degree (four counts), rape in the third degree (four counts), criminal sexual act in the third degree (five counts) and sexual abuse in the third degree (three counts), without a hearing; App. Div. affirmed.
