ORDERED that its decision and order on motion dated June 22, 2004, in the above-entitled matter is recalled and vacated, and the following decision and order on motion is substituted therefor:

The Grievance Committee has apprised the court that, on April 19, 2004, the respondent was found guilty, after a jury trial in the United States District Court for the Southern District of New York, of the following federal felonies: mail fraud, in violation of 18 USC § 1341; making false statements relating to health care matters, in violation of 18 USC § 1035(a); health care fraud, in violation of 18 USC § 1347; witness tampering, in violation of 18 USC § 1512(b); making false statements to the FBI, in violation of 18 USC § 1001(a); and conspiracy, in violation of 18 USC § 371. The Grievance Committee has submitted a certified copy of the transcript of the jury charge and verdict. The respondent is scheduled to be sentenced on August 20, 2004. The respondent was admitted to the Bar at a term of the Appellate Division of the Supreme Court in the First Judicial Department on September 24, 1998.

Upon the papers submitted to this court, it is

ORDERED that on the court's own motion, the respondent is immediately suspended from the practice of law as a result of his being found guilty of a serious crime, and continuing until further order of this court, pursuant to Judiciary Law § 90(4)(f); and it is further,

ORDERED that the respondent shall promptly comply with this court's rules governing the conduct of disbarred, suspended, and resigned attorneys (22 NYCRR 691.10); and it is further,

Upon the papers filed in support of the motion and no papers having been filed in opposition or relation thereto, it is

ORDERED that the branch of the motion which is for leave to prosecute the appeal on the original papers is denied as unnecessary (see 22 NYCRR 670.9[d][1]); and it is further,

ORDERED that the branch of the motion which is for leave to prosecute the appeal as a poor person and for the assignment of counsel is granted; and it is further,

ORDERED that the appeal will be heard on the original papers (including a certified transcript of the proceedings, if any) and on the briefs of the appellant, the respondent, and the Law Guardian, if any. ORDERED that the stenographer(s) and/or the transcription service(s) is/are required promptly to make and certify two transcripts of the proceedings, if any, except for those minutes previously transcribed and certified (22 NYCRR 671.9); in the case of stenographers, both transcripts shall be filed with the clerk of the Family Court, and the clerk of the Family Court shall furnish one of such certified transcripts to the appellant's counsel, without charge; in the case of transcription services, one transcript shall be filed with the clerk of the Family Court and one transcript shall be delivered to the assigned counsel.
