These five claims arise out of a two-vehicle accident that occurred in the afternoon on September 13, 2009 at the intersection of State Route 82 and County Route 90 [FN4] in the Town of Union Vale, Dutchess County. The trial was bifurcated and this Decision pertains solely to the issue of liability.
