Opinion 06-71


         This is in response to your inquiry (06-71) in which you ask whether it is ethically permissible for you to administer the oath of office to the president-elect of a Democratic Club during a club fund-raising event. You have further explained that your role would be limited to administering the oath and that you would leave immediately afterwards. You have also indicated that you are no longer within your “Window Period.” 22 NYCRR 100.0(Q).


         This Committee has previously concluded that ordinarily, administering the oath of office of elected officials is entirely in keeping with the accepted role of judges in our society insofar as it relates to a civic function. Opinion 97-145 (Vol. XVI). Pursuant to the Rules Governing Judicial Conduct, however, a judge may not attend political gatherings or participate in political activities except during his or her Window Period. 22 NYCRR 100.5(A)(1)(e), (g). Because the event you describe is a political fund-raiser, and you are not within your Window Period, you may not attend.
