Opinion 12-190

June 10, 2013

Dear Judge:

This responds to your inquiry (12-190) asking whether, after you assume the bench, you may continue to use the e-mail address you had used for your law practice and personal e-mails.

The Committee previously advised that a judge may continue to use his/her law office e-mail address solely for personal matters, so long as the judge would not permit former clients or others to draw the judge into prohibited ex parte communications or the practice of law (see Opinion 10-52). Subject to the same limitations, you also may continue to use your law office e-mail address.

I have enclosed Opinion 10-52 for your convenience.

Very truly yours,

George D. Marlow, Assoc. Justice

Appellate Division, First Dept. (Ret.)

Committee Chair
