         This responds to your inquiry (13-89) asking whether it is permissible for you to include a photograph of yourself, taken while wearing your judicial robe, on the back cover of a bench book you have authored.

         The Committee previously has advised that a judge may permit the use of his/her photograph, taken while wearing a judicial robe, in advertisements and promotions for a law book the judge authored (see Opinion 98-89 [Vol. XVII]). Similarly, you may include a photograph of yourself, taken while wearing your judicial robe, on the back cover of a bench book you authored.
