Opinion 90-161

January 7, 1991

Dear Justice

The Advisory Committee on Judicial Ethics, at its meeting of December 11, 1990, considered your inquiry (90-161), dated October 10, 1990, asking whether, as a part-time judge and town council member, you legally may notarize petitions of property owners concerning the dissolving of a garbage district.

Ethically, no prohibition exists to a judge’s administering oaths or taking acknowledgments. However, this Committee is not passing on the legality of the judge’s either notarizing petitions or serving as a member of the town board.

                                                                     Very truly yours,

Samuel J. Silverman
