Opinion 90-38

                                                     March 1, 1990

Digest:         A judge may attend an educational conference and receive           reimbursement for his expenses there from the nursing home where the judge is a member of the board of directors.

Rules:          22 NYCRR §100.6(b)

Opinion:

A full-time judge states that he is on the board of directors of a nursing home, that all the board members have been invited to an educational conference, and that the nursing home will pay for their lodging, travel and food. The judge inquires whether he properly may attend the conference. Neither the nursing home nor the sponsoring association are, or will be, engaged in any proceedings that would ordinarily come before the judge.

Section 100.6(b) of the Rules of the Chief Administrator provides that judges may receive reimbursement of expenses for extra-judicial activities “limited to the actual cost of travel, food and lodging reasonably incurred by the judge”. Accordingly, the judge may attend the conference, and may receive reimbursement for his actual expenses.
