Opinion 91-138

Digest:         A part-time judge may not be the honoree at a charitable fundraising testimonial dinner.

Rules:          22 NYCRR 100.5(b)(2).

Opinion:

A judge asks whether a part-time judge may be the honoree at a charitable fundraising testimonial dinner.

Section 100.5(b)(2) of the Rules of the Chief Administrator provides that, “no judge shall be a speaker or guest of honor at an organization’s fundraising events, but he or she may attend such events.” The exception incorporated in this provision for bar association or law school functions is inapplicable to this affair. Accordingly, the judge may not be the honoree at the fundraising dinner.
